Daniel Schmitt & Co. Scammers! 2012 - 2013 - 2014


It´s bout 3 weeks since talking to Jon Sherman salesman for Daniel Schmitt with no return call from him on the staus of the buy-back of my car at a lesser price. As I had offered it back to them for $22,500.00, having paid them $27,000.00 for the car. I called him and another salesman there told me Jon would return my call the next day. He did not!
When I called back the day after, Jon Sherman said he had talked with his ¨Boss¨and said they would only consider taking the ´74 Vette back in on consignment. Only after prompting did he admit that there would be costly fees for that service, and there were no guarranties Since I had already dropped the price I wanted to recover for the car by about $5,000.00 I told him that was impossible.
This whole deal was a scam from the beginning, in that upon first phone contact with Daniel Schmitt & Company I was required by Jon Sherman to put a deposit of $2,000.00 on my Mastercard, to hold the car for my inspection.(Later Jon told the $2,000.00 was non-refundable if I didn´t buy th car)
Then he emailed me papers to sign and send back which turned out to be an agreement to purchase, upon which I inserted the words ¨upon inspection¨(which he told me was meaningless)
I felt preasured by Jon because of the deposit situation and because they were able to keep me from seeing the frame damage through use/positioning of hoist pads I had no out and felt obligated to take the car. (1picture of 2 in original report)
It´s Dealers like Daniel Scmitt & Company in St Louis, who give the whole car sales industry a black eye with their sleezy, underhanded way of doing business.

Thus Schmitt Classic Cars solves his problems and complaints.

As no proffesional car dealer I completely panicked because I was scammed by Daniel Schmitt Classic Cars. The only way I thought to threaten was bad feedback. In response, I received the following email.


We insist you immediately stop your unjust and unwarranted negative campaign against us at once. Already, you have caused harm and significant damage to our business and otherwise outstanding reputation. As someone who owns and operates an online business, you are certainly aware that you yourself are vulnerable to someone intent on raising doubt about the trustworthiness of your business, even if that doubt created is unwarranted as you have done to us. We have retained an IT firm who assures us you have much greater exposure, and risk tremendous loss if a similar campaign were undertaken against your various business interests. Until just recently, this had been an unthinkable option, yet now this firm stands at the ready and is awaiting word regarding your decision to stop your smear campaign against us.

We would also remind you that we have an electronic record indicating your intention to be less than forthright with customs authorities regarding the true amount you paid for your vehicle. It would be an unfortunate, but now very possible scenario in which we would turn over this information to the Netherlands Ministry of Finance, so the matter of your potential tax evasion might be fully investigated.

Again, it has always been our hope to bring about an agreeable conclusion to this matter. Regrettably, it has been your choice to pursue a path of unreasonableness even as a perfectly reasonable solution lay before you. Unless you immediately abandon your negative campaign against our company, we will have no other course of action but to meet your aggression toward us with equal or greater combativeness in return.

Schmitt strikes again; July 01, 2013, false advertising and fraudulent discussions.

To whom it many concern,
The summary below is a synopsis of the car purchased from Daniel Schmitt & Co. under false advertising and fraudulent discussions.
1.MJC Classic Cars, LLC of Lakeland, Florida had been searching for a 1964 Eldorado Convertible for a German client. The client requirements were to locate a fully restored vehicle needing little or no repairs, ready to drive.
2.MJC observed an advertisement on eBay Motors for such a car. A triple black Eldorado VIN#64E005759 as advertised under the eBay user ID carsbyschmitt.com in September, 2012.
3.As advised in the listing, Michael Calhoon, President of MJC telephoned Schmitt sale representative John Sherman to complete a full walk around and discuss the car. He also visited the www.schmitt.com website for additional information on the vehicle.
4.Michael is an experienced licensed classic car dealer. He asked John Sherman all the needed questions concerning the condition of this Eldorado and what needed repair. He was assured the car was as advertised, a spectacular restoration. Michael was told the car included a completely rebuilt drive train and all aspects of the car were restored.
5.When asked about needed repairs, he was advised by John that only three repairs were needed. The air conditioning system, the radio, and the clock. Michael asked many questions about specific parts of the car and their condition.
6.Michael explained to John this car was being purchased for a German client planning on driving it extensively in the United States the spring 2013.
7.MJC agreed to purchase the car for $50,000, with Schmitt properly repairing the air conditioning system and MJC repairing the clock and radio after arrival at our facility in Florida.
8.In early November, 2012, John advised MJC the A/C was repaired and the car was ready to ship. MJC wired the balance of $48,000 to Schmitt and contracted the MJC shipper to deliver the car to the MJC Florida dealership.
9.Upon arrival, it was evident there were many glaring, undisclosed cosmetic issues with the car, easily observed on the first walk around. MJC mechanics determined on check-in the newly repaired A/C system was not working. It was also observed extra wires had been added underhood to bypass the factory climate control system of the car. It was also determined the A/C system had zero freon in the system and after performing a leak check, determined the cars A/C system had many leaks. The system had not been properly repaired and was actually in worse condition after the botched repairs than if they had left it alone.
10.John Sherman received a list of repairs that were needed including the A/C system via fax on January 11, 2013. A follow-up phone call with John to express our displeasure was made. He told Michael he would discuss the issues with the owner, Daniel Schmitt. The estimated repairs identified were $2,550 and the additional unknown cost to repair the A/C system.
11.On January 12th, John Sherman advised Daniel Schmitt had approved a total of $450 for the A/C repair and the agreed $350, so a total of $800. This is the second time Schmitt sought to cheat MJC and did not keep their word.
12.Over the next few weeks, MJC fought with Schmitt and the Schmitt legal counsel over the repairs. During this time, the rebuilt engine and transmission were pulled for reseal due to heavy fluid leaks. It was determined the Schmitt also lied about the drive train rebuild and it was worse than thought. The engine and transmission needed a complete rebuild. They were original and completely worn out, never had been rebuilt. They would not have driven 500 miles without a major calamity. This escalated the total estimated repair bills to at least $14,000 on this car. MJC requested its reimbursement demand be increased to $5,000.
13.On January 17th, 2013, Daniel purchased similar domain names at www.godaddy.com to www.mjcclassiccars.com . He emailed the invoice to Michael, threatening to start a smear campaign of MJC if it posted online complaints about his company.
14.Daniels corporate counsel, Kenneth Schwartz, contacted Michael direct to try and broker a settlement of the $5,000 demand for repair reimbursement. $3,000 was offered by the attorney and was rejected by MJC.

Never ever trust the Company Daniel Schmitt Classiccars

What happens if you buy a car unseen on ebay ;



It is a big disappointment.
I have 62 photos of damage, and this is without the pictures of the engine
It is certainly not “beautifull restauration”
Despite my request, and your email confirmation,
sat the original sales receipt with the documents.
So I have twice as many duties paid

COA Porsche document is not in the car
(is the car really matching number ??)

Whole car is full of filler
Rust holes are filled with thin layer of fille
Rear Deck, can not be mounted, chassic inside is rotten from rust
Front Fender Left , rust holes on the inside filled with Teflon tape
Front Fender right, holes on the bottem side
Front Bumper is completely rust holes
Rear Panel, filler and fiber mats
Chassis left, inner sill outer sill, pieces welded
Chassis right, painted on the rust over inner sill
Rusted doors on left and right on bottom
Hood completely rust full of filter

Chrome frames are glued on the chassis, and let loose
Door and window on driver are skewed
Almost all rubbers are loose or badly glued.
On almost all rubbers sits paint
Driver's seat, the frame is broken
Wheelhouse rubber, left and right torn

Air condition is not working
Hazard is not working
Beam is not working
One window does not close
Gearbox oil leaks
Engine block is leaking a lot of oil (it trickles out)
Heat exchanger is sprayed with silver flammable paint
Oil level transmitter is unusable
All rubbers in the suspension are porous or rotten
Raised wheel HUB steerwheel is not in the car !
(The steering has exceeding play)
Radio “Frankfurt” is not in the car !
Shock absorbers are worn
Head gaskets must be replacement

Wiper pump and watertank is missing
